1. Acceptance of Terms

By placing a pre-order or purchasing any supplement product from NORTH Performance, you represent that you are at least 18 years of age, are a recreational athlete or consumer purchasing for personal use, and that you have read, understood, and agree to be bound by these Terms and Conditions.

2. Health & Safety and Medical Disclaimer

Our products and any information provided on our website, social media, emails, or other channels are intended for generally healthy recreational athletes and consumers and are for informational purposes only.

They are not intended to diagnose, treat, cure, or prevent any disease and do not constitute medical advice, nutritional counseling, or individualized training advice.

You must not rely on any information from NORTH Performance as a substitute for professional medical advice, diagnosis, or treatment, and you should always consult with a physician or other qualified healthcare professional before using any supplement product, especially if you have a medical condition, are pregnant or breastfeeding, are taking prescription or over-the-counter medications, or have any concerns about your health.

Use of our products and information is at your sole risk, and you agree to discontinue use and seek medical attention immediately if you experience any adverse reaction, discomfort, or unexpected symptoms.

3. Recreational Athlete Responsibility and Appropriate Use

As a recreational athlete or consumer, you are solely responsible for determining whether any NORTH Performance product is appropriate for your personal training, competition, or lifestyle goals and for using our products in accordance with the product label, these Terms and Conditions, and any guidance from your healthcare professional.

We do not guarantee any specific performance, fitness, weight loss, or health outcomes, as individual results vary based on training status, nutrition, sleep, and other personal factors.

You agree not to exceed recommended servings, not to combine our products with other substances in a manner inconsistent with product labeling or medical advice, and not to use our products in any way that violates the rules or guidelines of any recreational league, competition, or event in which you participate.

4. Pre-Order & Product Availability

NORTH Performance offers products that may be subject to manufacturing, supply chain, or fulfilment delays. While we make every effort to deliver products within the estimated timeframe communicated at the time of purchase, we cannot guarantee delivery dates.

Estimated delivery windows are provided in good faith and are subject to change without prior notice due to circumstances within or beyond our control, including but not limited to:

Manufacturing delays
Ingredient or raw material shortages
Shipping carrier delays
Regulatory review or compliance requirements
Acts of God, natural disasters, or force majeure events

5. Delivery Delays & Inability to Fulfil Orders

If NORTH Performance is unable to fulfil your order within a reasonable timeframe, or if a significant delay is anticipated beyond the originally communicated delivery window, we will notify you via the email address provided at checkout.

In such cases, you will be offered the following options:

Continue to wait for your order to be fulfilled once the product becomes available; or
Request a full refund of the amount paid.

6. Refund Policy

If NORTH Performance is unable to deliver your order and you elect to receive a refund, the following terms apply:

Refunds will be issued to the original payment method used at the time of purchase.
Refunds will be processed within 10 business days of your refund request being approved.
NORTH Performance will not be liable for any additional costs, losses, or damages arising from a delivery delay or inability to fulfil an order beyond the refund of the original purchase price.
Refunds cover the product purchase price only. Any applicable taxes refunded will be in accordance with applicable US law.

7. Cancellation Policy

You may cancel your order at any time before it has been fulfilled and shipped. To cancel, visit account.northperformance.com or contact us with your order number. Once cancelled, a full refund will be issued to your original payment method within 10 business days. Once your order has been dispatched, it can no longer be cancelled.

8. How to Request a Refund

To request a refund due to non-delivery or significant delay, please contact us. We aim to respond to all refund requests within 2 business days.

9. Limitation of Liability

To the fullest extent permitted by applicable law, NORTH Performance's liability to any customer in connection with a delayed or unfulfilled order shall be limited solely to a refund of the purchase price paid. NORTH Performance shall not be liable for any indirect, incidental, consequential, or punitive damages arising from a failure to deliver.

Without limiting the foregoing, NORTH Performance makes no representations or warranties that any product will improve performance, fitness, or health outcomes for recreational athletes, and you acknowledge that any decision to use our products is made by you in consultation with your healthcare professional.

Nothing in these Terms and Conditions excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for personal injury caused by our gross negligence or willful misconduct.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States and the state in which NORTH Performance operates, without regard to conflict of law principles.

11. Changes to These Terms

NORTH Performance reserves the right to update or modify these Terms and Conditions at any time. Any changes will be posted with an updated effective date. Continued use of our website or services following such changes constitutes your acceptance of the revised terms.
